Appeals
An appeal is a request to have a court case or decision reviewed by another court. Appeals from Denver County Court are reviewed by Denver District Court.
This information is only intended to give a general understanding of the appeal process. It does not cover everything you may need to know to proceed with an appeal. You may wish to seek the advice of an attorney. The Denver County Court and its employees cannot provide legal advice.
Civil Appeals
For Civil and Small Claims appeals, the process follows the Colorado Rules of County Court Civil Procedure Rule 411 and requires that a Notice of Appeal, Designation of Transcript, Posting of the Appeal Bond, and payment of the Transcript Deposit are all due within 14 days of the final judgment or decision being appealed AND to file the appeal and pay any docket fee in the Denver District Court within 35 days of filing the Notice of Appeal in the Denver County Court.
State Criminal, Municipal (General Sessions), State & Municipal Traffic and Parking Violation Appeals
For state criminal misdemeanors, municipal general sessions, state and municipal traffic cases and municipal parking violations, the appeals process follows the Colorado Rules of Criminal Procedure Rule 37. A Notice of Appeal and Designation of Transcript are due to be filed with both the Denver County Court and Denver District Court within 35 days of sentencing or denial of a post-trial motion.
Appeal Transcript Requests
An essential part of the appeals process may involve requesting official transcripts of your case. Please complete the Transcript Request form. When completing the form mark the Yes checkbox in the section indicating “This transcript request applies to an appeal” . For the appellate record to include transcripts, a Transcript Deposit of $200 and any additional transcription costs must be paid timely to the outside transcriber service, or the appeal may be considered abandoned. Transcript costs cannot be waived. The transcript request form must be submitted via the online form or by sending a completed JDF4 form to dcctranscriber@denvercountycourt.org.

Specialty Courts & Programs
Sobriety Court
Sobriety Court was established in 2011, to support individuals with repeat DUI offenses build lasting recovery and create healthier, more stable lives. Rather than relying solely on traditional court processes, Sobriety Court offers a structured, supportive program that combines treatment, accountability, and encouragement. Sobriety Court supports recovery and reduces impaired driving by providing a collaborative, respectful, and accountable approach that promotes participant success, personal growth, and community safety. Participants in Sobriety Court work closely with a team of professionals who provide individualized support, treatment services, and regular check-ins. Participation is voluntary and based on both legal and clinical eligibility and includes five phases that typically take approximately 14–24 months to complete. Sobriety Court is a state accredited treatment court designed for adults with second or third DUI offenses.

Competency Diversion Program
The Competency Diversion Program was established in 2022, to serve individuals who are not likely competent to proceed and divert them directly to community mental health treatment and services. Through a collaborative partnership with Bridges of Colorado, individuals with eligible felony and misdemeanor charges are supported in completing an individualized care plan designed to reduce barriers and facilitate access to continuing mental health care and resources. Individuals will not have formal competency raised, will not be ordered for competency evaluation, and will not be ordered into restoration. The focus is on continuity of care, increased recovery rates, and reducing the filing of formal competency in the court system. Successful diversions will result in the individual having their case dismissed and records sealed.

Competency Support
In 2024, the Competency Support Docket was established as an expert docket for all misdemeanor cases in which competency-to-proceed has been questioned or raised. The goal of this specialty docket is to connect these defendants with mental health support services, while at the same time allowing for legal proceedings to continue as quickly as possible. This docket is staffed by designated court stakeholders with expertise in competency-related resources, case proceedings, and guidance through justice-involved programs, case pathways, and dismissals. This approach supports equitable and procedural justice in that all docketed individuals for whom competency is questioned, or formally raised, have the same opportunities for connection to programs, resources, services, and specialized expertise of the stakeholders handling the cases.

Forensic Peer Support Team (FPST)
In 2020, Denver County Court established a team of peer professionals who have personal experience in recovery from their own substance use disorder and/or mental health challenges, and who have been impacted by justice involvement. Each peer professional is educated, trained, and certified to assist others facing similar challenges navigate the justice system. The team helps connect clients to community resources—including recovery, employment, housing, treatment, benefits, and basic needs—while supporting client-centered goals and fostering empowerment. Because the justice system can impact individuals in complex ways, navigating it is often best understood by those with lived experience.

Outreach Court
In 2016, the City and County of Denver began offering Outreach Court to increase stabilization and reduce future interactions with the justice system for individuals experiencing housing instability or receiving homeless or transitional services. Outreach Court helps individuals resolve municipal-level citations or warrants and provides direct, immediate access to supportive services and resources which can include, but are not limited to, substance use and mental health services, public transportation, vital documents, as well as providing peer support services. Immediate community service options are also available to complete court requirements. The program is a partnership
between Denver County Court, Denver City Attorney’s Office, Office of the Municipal Public Defender, Denver Public Library, Denver Human Services and many community providers.

Recovery Court
Recovery Court was established in 2026, and is a collaborative treatment court program serving individuals with misdemeanor drug related and drug adjacent convictions. Recovery Court offers a specialized, systemic process for a pathway to recovery that prioritizes the individual’s unique needs and places them at the center of their own care. This program focuses on individuals struggling with substance misuse and/or co-occurring challenges which may include a brain injury, a mental health condition(s), and/or trauma. Successful completion of the program can lead to a case being pleaded down or a case being dismissed and the potential for the individual to have their record sealed.
