Appeals

An appeal is a request to have a court case or decision reviewed by another court. Appeals from Denver County Court are typically reviewed by Denver District Court.

 This information is only intended to give a general understanding of the appeal process. It does not cover everything you may need to know to proceed with an appeal. You may wish to seek the advice of an attorney. The Denver County Court and its employees cannot provide legal advice.

Forensic Peer Navigators (Peer Support Specialists)

The experience with the justice system impacts an individual’s life in many ways and it is best understood by individuals who have experienced similar issues. Denver County Court employs a team of Peer professionals to support any individual in the Denver County Court system going through the justice process. Forensic Peer Navigators are people who use their own experience in recovery and training in peer support to help others who are facing similar problems. Forensic Peer Navigators can help connect individuals to resources in the community for recovery, jobs, housing, treatment, and more. They can help individuals set and meet goals, go to appointments and recovery meetings, and offer support while handling justice involvement.

Outreach Court

The City and County of Denver offers Outreach Court to help people experiencing housing instability gain better access to the County Court system and avoid deeper involvement with the justice system. Outreach Court is designed to increase stabilization and reduce future interactions with the justice system for individuals experiencing housing instability or receiving homeless or transitional services. Outreach Court helps individuals resolve municipal level citations or warrants and provides direct, immediate access to supportive services and resources which can include but are not limited to substance use and mental health services, public transportation, vital documents, as well as providing peer support services. Immediate community service options are also available to complete court requirements. The program is a partnership between Denver County Courts, Denver City Attorney’s Office, Office of the Municipal Public Defender, Haven of Hope, Denver Public Library, The A.I.D. Center, and many community providers.

Wellness

Wellness is a voluntary harm reduction program designed to address the quick release process for individuals with municipal level cases and behavioral health needs by providing identification in the booking process and offering immediate connection at the Downtown Detention Center. Completion of programming results in case dismissal. The Wellness Program is located at the Van Cise-Simonet Detention Center at 490 W. Colfax Ave., Denver CO 80204, in Office 2100, next to Courtroom 2100. To reach the Wellness Program, please call or text 720-793-5045.

Competency Diversion

Denver County Court’s Competency Diversion Program is a true diversion program designed to serve individuals with eligible misdemeanor and felony level offenses. The program identifies individuals who are not likely competent to proceed and diverts them directly to community mental health treatment and services. Through a collaborative partnership effort, the individual is supported in completing an individualized treatment plan designed to reduce barriers and facilitate access to continuing mental health care and resources. Individuals will not have formal competency raised, will not be ordered for competency evaluation, and will not be ordered into restoration. The focus is on continuity of care, increased recovery rates, and reducing the filing of formal competency in the court system. Successful diversions will result in case dismissal and sealed records. Competency Support Docket

Denver County Court has established an expert docket for all misdemeanor cases in which competency-to-proceed has been questioned or raised. The goal of this specialty docket is to connect these defendants with mental-health support services so that they get the help they need, while at the same time allowing for legal proceedings to continue as quickly as possible. This docket will be staffed by designated stakeholders who have an expertise in competency-related resources, case proceedings, and guidance through justice-involved programs, case pathways, and dismissals. This approach supports equitable and procedural justice in that all docketed individuals for whom competency is questioned, or formally raised, have the same opportunities for connection to programs, resources, services, and specialized expertise of the stakeholders handling the cases. Sobriety Court (DUI Treatment Court)

The Sobriety Court began operation in 2011 as an alternative to traditional methods of disposition for repeat DUI offenders. The program identifies, assesses, and provides intensive treatment and supervision to participants. It is not probation in the traditional sense; it is a treatment program that models the Ten Guiding Principles of DWI Courts (applied to Colorado DUI Courts). The program allows participants the opportunity to learn about addiction, themselves, and how to live a sober life. This results in better, more productive lives for the participant and those around them. The mission of the Sobriety Court is to provide an effective, efficient, judicially supervised, accountable, systemic process to address addiction, offender success, and recovery.

Sobriety Court is a State Accredited treatment court serving individuals with second and third DUIs in Denver County. It was developed to reduce the recidivism of drunk driving in the City and County of Denver. The Sobriety Court targets adults (18+) charged with repeat impaired driving offenses. The program is designed for individuals who need a structured intensive program and have a willingness to receive treatment for substance misuse. This program is voluntary and eligibility for the program is based on legal and clinical screening. It consists of five phases and is approximately 14-24 months in length. Helping, Engaging, Motivating (H.E.M.)

HEM is a voluntary, short-term harm reduction program designed to meet individuals where they are, engaging and helping them meet their goals to better their well-being and decrease their contact with the criminal justice system. The program provides individuals charged with a Drug Misdemeanor (DM1) an opportunity to connect to resources and services addressing needs that are potential underlying causes of criminal behavior. On March 1st, 2020, HEM was launched in congruence with Colorado House Bill 19-1263 that reduced the penalty for drug possession charges from a felony to a misdemeanor (DF4 to DM1).
