EXECUTIVE ORDER

AUTHORITY FOR CLERICAL STAFF TO SEAL CONVICTION RECORDS FOR VIOLATIONS OF §18-4-802 PURSUANT TO §24-72-308.8(3)

For any case(s) where a defendant has received a penalty assessment and/or a summons and complaint for a violation(s) of §18-4-802 C.R.S., authority is hereby conveyed to any Deputy Clerk of the Court, upon a Motion by the defendant, to administratively grant an Order to seal the conviction record of the case, provided ALL of the following criteria are met:

  • The citation for violating §18-4-802 C.R.S. was issued prior to June 9th, 2012;
  • The conviction for violating §18-4-802 C.R.S. entered on or after June 9th, 2012
  • All fines, costs and fees have been paid in full;
  • The defendant is in compliance with all non-monetary sentences, if any;
  • The defendant tenders to the Court the standardized Motion and Order, provided by the court, to seal the conviction record.

Upon the granting of the Order, the Deputy Clerk shall immediately forward the case to any supervisor within the Combined Civil/Traffic or General Sessions/Criminal Division, at which time a supervisor shall immediately seal the record.
