Competency Diversion

Denver County Court’s Competency Diversion Program is designed to serve individuals with misdemeanor and felony level offenses who have been found incompetent to proceed in the last three years. The program identifies eligible individuals who are not likely competent to proceed and diverts them directly to community mental health treatment and services. Through a collaborative effort, the individual is supported in completing an individualized treatment plan designed to reduce barriers and facilitate access to continuing mental health care and resources. Individuals will not have formal competency raised, will not be ordered for competency evaluation and will not be ordered into restoration. The focus is on continuity of care and increased recovery rates, resulting in no charges being filed and reducing the filing of formal competency in the court system.
