Pursuant to 13-6-410 C.R.S., when appealing a Small Claims matter, a party has a choice as to how to obtain the transcript for their appeal. By law, they may obtain a typed transcript produced at a per-page fee, or a copy of the audio recording of the trial proceedings. Audio recordings are produced at a fee of $35 per compact disk.
The decision as to what method to select for obtaining the transcript is up to the party filing the appeal. Although a copy of the audio recording may be allowed by statute, it may NOT be the preferred manner in which District Court receives the transcript.
The use of an audio recording to satisfy the transcript requirement for an appeal applies ONLY to small claims matters.
